These Terms of Use ("Terms") govern your use of the Auto Teletech platform ("Platform"), including both the Auto Teletech website for car owners (https://www.autoteletech.com/chat) and the dedicated page for auto mechanics (https://www.autoteletech.com/). By accessing or using the Platform, you agree to be bound by these Terms. If you disagree, you must not access or use the Platform.

1. Introduction

Auto Teletech is a platform that enables independent auto mechanics to offer paid video consultations to car owners who need advice or help with their car issues. Our platform facilitates two distinct business models:

  • Direct Video Consultation (DVC): A service where car owners submit car issue requests through the mechanic's dedicated video consultation link, allowing them to book and pay directly with the mechanic. Mechanics promote their own consultation link to attract customers.
  • Marketplace Video Consultation (MVC): A service where car owners submit car issue requests, and auto mechanics bid on the job to win the consultation. Auto Teletech promotes the platform to attract customers.

2. Definitions

  • "Car Owner" means any individual or entity seeking auto repair or diagnostic services via video consultation.
  • "Auto Mechanic/Contractor" means any auto repair shop or individual auto mechanic, or auto technician registered on the Platform, providing services on an independent contractor/freelance basis.
  • "Consultation" refers to the video-based service session between a car owner and an auto mechanic.
  • "Commission Fee" means the percentage fee applied by Auto Teletech on each successfully completed consultation (currently 25%, subject to change).

3. Eligibility and Account Registration

  • Eligibility: You must be at least 18 years old and have the legal capacity to enter into a binding agreement.
  • Account Registration: Car owners and auto mechanics must register and provide accurate, current information. Auto mechanics are required to link a valid payment account (e.g., Stripe) to receive payments.

4. Independent Contractor/Freelance Relationship

  • Independent Status: Auto mechanics/contractors/freelancers are independent service providers. Nothing in these Terms creates an employment, partnership, joint venture, or agency relationship between Auto Teletech and any auto mechanic/auto technician. Contractors are solely responsible for their tax obligations, insurance, and compliance with applicable laws.
  • No Agency: Auto Teletech does not control the manner or means by which auto mechanics perform their services.

5. Use of the Platform and Service Process

5.1. Bidding and Service Requests (MVC)

  • Customer Requests: Car owners post consultation requests on the marketplace.
  • Bidding: Independent auto mechanics may bid to provide the requested service. The bidding process is competitive and is solely between the car owner and the bidding mechanics.
  • Acceptance: Once a car owner accepts a bid, an agreement is formed between the parties, subject to these Terms.

5.2. Dedicated Video Consultation (DVC)

  • Customized Link (URL): Independent auto mechanics/auto technicians register to receive a dedicated video consultation link. They may market this link directly to their existing or new customers.
  • Direct Engagement: Consultations initiated via the dedicated link are arranged directly between the car owner and the auto mechanic/auto technician, with Auto Teletech facilitating the transaction through Stripe and charging a platform commission fee.

6. Payment Terms and Commission

  • Payment Process: Payments for consultations are processed through the Platform. Funds are held in escrow until the video consultation is completed between the car owner and the auto mechanic/auto technician.
  • Commission Fees: Auto Teletech retains a commission fee from each completed consultation (currently 25%, subject to change). These fees may be updated from time to time, with notice to independent auto mechanics/auto technicians.
  • Refunds and Disputes: In case of disputes or refund requests, Auto Teletech will provide mediation in accordance with the dispute resolution process outlined below.

7. Dispute Resolution and Limitation of Liability

  • Dispute Resolution: Users agree to resolve any disputes arising from the use of the Platform through informal negotiation, followed by binding arbitration if a resolution cannot be reached. Auto Teletech may act as a mediator, but it is not responsible for the outcome.
  • Limitation of Liability: Auto Teletech acts solely as an intermediary between car owners and auto mechanics. It is not liable for any direct, indirect, incidental, or consequential damage arising from the performance or non-performance of any service provided by the independent contractors.

8. Intellectual Property

  • Ownership: Auto Teletech retains all rights to its platform, content, and underlying technology. Independent auto mechanics/auto technicians and car owners grant Auto Teletech a non-exclusive license to use, display, and distribute content posted on the Platform as necessary to provide the service.
  • Work Product: Unless otherwise agreed in writing, all intellectual property rights in the work product created during a consultation are transferred to the car owner upon full payment and acceptance of the service.

9. User Obligations and Conduct

  • Accurate Information: All users must provide accurate and complete information during registration and use of the Platform.
  • Compliance: Users agree to abide by all applicable laws and regulations in connection with their use of the Platform.
  • Prohibited Activities: Users must not engage in fraudulent behavior, misrepresentation, or any activities that could harm the reputation or operation of Auto Teletech or its users.

10. Termination and Suspension

  • Termination by Auto Teletech: Auto Teletech reserves the right to suspend or terminate access to the Platform at its sole discretion, without prior notice, if a user violates these Terms.
  • Termination by User: Users may terminate their accounts at any time; however, any outstanding obligations (e.g., pending payments or disputes) shall remain in effect.

11. Modifications to the Terms

Auto Teletech reserves the right to modify these Terms from time to time. Continued use of the Platform following such changes constitutes acceptance of the new Terms.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Auto Teletech is headquartered, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

13. Miscellaneous

  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
  • Entire Agreement: These Terms, along with any policies referenced herein, constitute the entire agreement between the parties regarding the use of the Platform.
